Obiettivi formativi

The aim of the course is to discuss the working of the EU institutions, some of its key constitutional principles and options for future development of the European Union at an advanced level.
Students are encouraged to think critically and offer their own ideas. The course will serve as a basis for practice or r search in this broad area of law and will offer a
broader perspective that strictly legal, also inspired by the literature from
social sciences and humanities.

On successful completion of this module students will be able to:

- critically reflect on key constitutional principles and the functioning of the European Union institutions;

- synthesize key writings and thinking on the constitutional and institutional developments of the European Union;

- demonstrate an ability to use legal analytical skills, legal research and writing in this specialized area of law.

Students following this course shall be evaluated in part for their classroom participation/work (30 %), in part on the basis of a paper to be written in English, on topics relating to the course, either assigned by the teacher or agreed with the teacher (70 %)

Programma

10 key topics to be covered (subject to slight changes):

1. Constitutional process in a polity sui generis: supranationality, sovereignty and constitutionalism (2 classes).

2. Supremacy and direct effect: a foundation of the European constitutional order? Contrasting perspectives on the nature of the foundational principles of EC law.

3. The European Courts: co-operative partnership or hierarchical relationship? ECJ, CFI and the European function of the national courts of the Member States. Article 234 EC.

4. Executives of the Member States as Community executives. The notion of the European Administrative Space. Article 10 EC. Fédéralisme d’exécution.

5. The Parliaments in Europe. The European Parliament and the national Parliaments of the Member States. The national Parliaments: ‘Losers’ or ‘masters’ of integration?

6. The principle of subsidiarity and embryonic federalism.

7. European Union and human rights. Two international human rights protection systems in Europe. The protection of Human rights as a constitutional principle of the EU. (2 classes).

8. Citizenship and Constitutionalism: The citizenship of the European Union and the nationality of the Member States. The implications for democracy and Constitution-building.

9. Current challenges.

The course consists of 8 meetings, 2 hours each, conducted once per week by Prof. Kochenov and of 4 additional hours imparted by a teaching assistant that will introduce students to research methods in EU law.

The course is an intensive course, and requires very good language skills (both oral and written). Students will have to read materials before classes and must be prepared to discuss them in class. Therefore, although classroom presence is limited to 20 hours, the workload for this course is equivalent to that which is required by a 40 hours course
